STEP BY STEP GUIDE TO THE LEGAL PROCESS

 

 

 

OUR FEES

 

 

PURCHASE TRANSACTION

STEP 1

Instruct McEwens Solicitors

STEP 2

You pay the local search fee & fees indemnity premium and submit your mortgage application.  We receive the estate agents' notification of sale and request contract papers.

STEP 3

On receipt of contract papers we request the local search, check the contract papers and send you a fixtures list to fill in. 

STEP 4

We receive and check local search.  The house is valued on behalf of your mortgage lender.  You consider whether you require a homebuyers survey in addition to any valuation obtained by your mortgage lender. 

STEP 5

We receive your mortgage offer and report to you. 

STEP 6

You sign contracts in preparation for exchange.  Completion dates are discussed.  We require your deposit (unless this is coming from any related sale). 

STEP 7

Contracts are exchanged.  You are legally bound to buy the house on completion.  Your buildings and life insurance are put into force.  We request the mortgage funds and balance due from you. 

STEP 8

You book your removers (or van if moving yourself). 

STEP 9

We send you a statement of a/c and you send us the balance due to complete at least four days before.  

STEP 10

Completion.  You move into your new home.

STEP 11

We register you as the new owner of the house, send you a copy of the Deeds and forward the originals to your mortgate lender or to you if you have no mortgage.

 

 


SALE TRANSACTION

STEP 1

Instruct McEwens Solicitors

STEP 2

Draft Papers are sent to your buyer's solicitor. 

STEP 3

Buyer's solicitor requests local search & returns approved contract.

 

STEP 4

The buyer's valuer surveys your house.  We arrange for you to sign the contract in preparation for exchange. 

STEP 5

Completion dates discussed with your buyer. 

STEP 6

Completion dates agreed with your buyer.  Your buyer give their solicitor the deposit for exchange.  

STEP 7

Contracts are exchanged.  You are now legally bound to move on the completion date.  You can now safely book your removals.  We request a redemption from your lender. 

STEP 8

We send you a statement of account and you provide us with the balance to complete (if any) at least four days before completion. 

STEP 9

Completion.  We pay the estate agent and redeem your mortgage (if you have one). 

STEP 10

You should liaise with your buyer to arrange the transfer of utilities, telephone etc. 

 

You move out by 2:00
